Summary of the Draft-Law for the Regulation and Control of Cannabis for Adults

The draft for the new law to regulate and control cannabis was introduced by the Grupo Parlamentario Mixto in the Spanish Congress on December 19, 2023, and approved for vote on January 9, 2024. It aims to regulate and control the consumption, possession, and production of cannabis for adults to address social, economic, and health issues associated with previous prohibition policies.

The Spanish Constitutional Court has deemed regional decisions regarding Cannabis Social Clubs unconstitutional. This has led to the development of a new legislative proposal aimed at creating a unified legal framework for the regulation and control of cannabis throughout Spain. This new draft law intends to standardize regulations and ensure compliance with national legal standards, addressing previous inconsistencies and providing clear guidelines for the operation of Cannabis Social Clubs.

The proposed cannabis regulation law has not yet passed through all legislative stages but is expected to proceed swiftly following the public consultation period, which was open until March 4, 2024. Given the broad consensus among political parties to establish a uniform legal framework for cannabis regulation across Spain, the legislation is anticipated to advance rapidly. All parties are keen to resolve the inconsistencies in regional regulations and provide clear, standardized guidelines for the operation of Cannabis Social Clubs nationwide.

Scope and Validity

  2. Geographical Scope
    1. The law applies throughout the entire territory of Spain.
    2. Regulatory Authority: The Spanish Agency for the Control of the Integrated Regulation of Cannabis (AECRIC) is the competent authority and is under the Ministry of Social Rights and the 2030 Agenda.
  3. Target Group
    1. The law is exclusively for adults, i.e., persons aged 18 and over. Minors are excluded from all activities related to cannabis.

Private Person Perspective

Permitted Activities for Private Individuals

  1. Possession and Consumption
    1. Adults may possess and consume cannabis as long as the legally established amounts are not exceeded
      1. Public Space: Maximum of 100 g of dried cannabis flowers, 30 g of cannabis extracts, or products containing a total of 10 g of THC.
      2. Private Space: Maximum of 3,650 g of dried cannabis flowers, 1,000 g of cannabis extracts, or products containing a total of 365 g of THC annually.
  2. Autocultivo (Self-Cultivation)
    1. Individuals or groups of up to five people in the same household may cultivate cannabis
      1. Outdoor Cultivation: Maximum of 20 cubic meters.
      2. Indoor Cultivation: Maximum of 1,200 watts of lighting power and 4 cubic meters of volume.
      3. Mixed Cultivation: The combined limits of the two cultivation methods must not be exceeded.
      4. Additionally, an area for mother plants and cuttings with a maximum of 400 watts of lighting and 2 cubic meters may be set up.

Prohibited Activities

  1. Minors
    1. All activities related to cannabis are strictly prohibited for persons under 18 years of age.

    1. The sale or distribution of cannabis products to third parties, even for free, is prohibited.
    2. No free samples of cannabis products may be distributed.

Limits and Distances

  1. Consumption Limits
    1.  A maximum of 90 g of dried cannabis flowers or equivalent products per month may be distributed to members of a cannabis club.
  2. Transport Limits
    1. A maximum of 100 g of dried cannabis flowers or equivalent products may be transported in public. For households with multiple adult consumers, the double amount applies.

Types of Cannabis Clubs

  1. Cannabis Social Clubs (Cooperatives): Non-profit associations that supply cannabis to their members through self-cultivation.

Establishment and Operation

  1. Clubs must not be established in residential buildings.
  2. Clubs must adhere to strict security and access controls to ensure only eligible members have access.

    1. Clubs are limited to distributing a maximum of 90 g of dried cannabis flowers or equivalent products per member per month.

Cannabis in airplanes or on ferries

The law does not clearly and explicitly regulate the transport of cannabis by airplane or ship.

There are general guidelines for the transport of cannabis, such as quantity limits for public spaces, but specific regulations for transport by airplane or ship, especially for private individuals, are not detailed.

It is only indicated that transport must be within the established limits and under certain conditions.

Due to the unclear regulations regarding the transport of cannabis by airplane or ship in Spain, it is advisable for recreational users to avoid traveling with cannabis. Although general guidelines allow for certain quantities to be transported in public spaces, specific rules for air and sea travel are not well-defined, which could lead to legal complications.

However, traveling with medical cannabis is possible, provided strict regulations are followed. This includes having a medical prescription, ensuring the product is clearly labeled, and carrying relevant documentation such as a purchase receipt and a certificate of analysis from the manufacturer. Compliance with these stringent requirements is essential to avoid issues during security checks and while traveling.
